Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Kitsch, the film generation platform operated by Kitsch ("Kitsch", "we", "us", or "our"). By creating an account or otherwise using Kitsch, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of service

Kitsch lets you organize assets, generate frames and shots using AI, and edit and export films. Features may change, be added, or be removed over time, and we may offer both a cloud-hosted version and a self-hosted (on-premise) version under separate commercial terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating an account and keep it up to date. Notify us immediately of any unauthorized use of your account.

4. Acceptable use

You agree not to use Kitsch to:

• Generate or distribute unlawful, defamatory, or infringing content
• Violate the intellectual property or privacy rights of others
• Generate content that exploits or endangers minors
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the service
• Resell or sublicense access to the service without our written consent

We may suspend or terminate accounts that violate this section.

5. Your content

You retain ownership of the assets, prompts, and films you upload to or generate with Kitsch ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to provide and improve the service. You are solely responsible for Your Content and for ensuring you have the rights necessary to upload and generate from it.

6. Billing and credits

Cloud usage is billed on a pay-as-you-go basis against purchased credits, as described on our pricing page. On-premise deployments are licensed under a separate annual agreement. Fees are non-refundable except where required by law or expressly stated otherwise.

7. Third-party AI providers

Generation features may rely on third-party AI models and infrastructure providers. We are not responsible for outages, errors, or content produced by those third-party providers, though we take reasonable steps to select and monitor them.

8. Intellectual property

Kitsch and its original content, features, and functionality are owned by Kitsch and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets except as necessary to use the service as intended.

9. Disclaimers

Kitsch is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated output may be inaccurate, unexpected, or unsuitable for your intended use, and you are responsible for reviewing it before relying on it.

10. Limitation of liability

To the maximum extent permitted by law, Kitsch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the service.

11. Termination

You may stop using Kitsch and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the service ends immediately, though certain provisions of these Terms survive termination.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you through the service or by other reasonable means. Continued use of Kitsch after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Kitsch is established, without regard to conflict-of-law principles.
